mons, on ThurlUay, January 1» 1807> and ordered to be t^iken
into cohfideration on the 19th of February, following.

" Great Britain and Ireland in Parliament aflembled "
** The bumble Petition of Tbomas Moulden^ H. Lark, R, Breokt,
arid G. iVarjuTf being Freemen of tbe City of Rocbefter.
" SHBWBTH,
** That your Petitioners now are, and at the time of the laft
Creneral £le6tion of Members to ferve in this prefent Parliament*
for the City of ilochefter, were Freemen of the faid City, and
claim to have had a right to vote^ and did vote at the faid £lec-
tloti That in C3n(equence of the diffolution of the late Parlia-
ment, an £le£Hon for members to ferve iu the prefent Parliament
for the faid City of Rochefter, was held at the Town-Hall of the
faid City of Rochefter, the 29th day of Odlober laft, and that the
Candidates for the faid City, were Sir William Sidney Smith,
John Calcraft, and James Bamett, £fquires.'*
** That a poll being duly demanded, the fame was granted l^

"Your Petitioners moft humbly reprefent that many perfons
who had no right or title to vote at the faid £le6tion, were received
and entered .on the Poll book in . favor of the faid James Bamett,
and that many pcrfons having a right and title to vote, and who
tendered their votes for Sir William Sidney Smith* were rejeded,
iindnot allowed to vote for him.*'
** That various irreffular, illegal, and violent a6ts and outrages

Election, and at and during the laid Ele^ion, and before his
Ele^ion, to (crve in this preient Parliament for the faid City of
Rochefler, at his own charge give, preient, and allow to divers
pedons, having votes in the faid £le6lion, money, meat, drink,
entertainments, and proviiion, and make prefents, gifts, rewards,
and entertainments, and promifes, agreements, obligations, and
engagements, to give and allow money, meat, drink, provifionsy
prefents, rewards, and entertainments, to and for fucn perfons,
and to and for the uie, advantage, benefit, emolument, profit,
and preferment of fuch perfons, in order to be ele6led, and for
being elected a member to ferve in this prefent Parliame»t for
the City of Rochefter aforefaid -, and that the faid James Bamett
before the faid Election, and at and during the (ame, by himielf,
his agents, friends, managers, partisans, and others on his
behalf regardlefs of the laws againft bribery and corruption,
and on the pains and penalties of perjury, and fuborration of
perjury, was guilty of fcandalous and notorious bribery and cor-
ruption, and corrupt praAices, in order to his being elected a
member to icrve in this Parliament for the faid City, and that
the faid James Bamett, before the faid Election and at and
during the fame, by himfelf, his agents, friends-, managers, and
partisans, and others employed by him and on his behalf, did by
gifts, reward^ and by promifes, agreements, and fecurities for
gifts and rewards, corrupt and procure divers perfons to give

Mr. Sergent Lens opened the Cafe of the Petitioners, and
ftated, that fbrty-lisven Freemen Were admitted on the 3d day of
November, in violation of an ex tiling Bye Law of the Corpora-
tion, that he (hould be able to eftablilh a clear Majority in favor
of Sir Sidney Smith, but if he failed in that, he diould be able
to prove fome extraordinary circnrndances and proceedings that
wnft, at all events, make it a void £le£lion.
The condu£l of the Mayor in calling a meetinr of the Cor*
poration, on the 3d of November, to admit t^neemen, was
irregular : that Mr. Dennis O'Brien with a degree of opennefs^

with many others. That two Aliens polled, Andrew Bullinari,
and J. A. B. Krull. That a Lunatic of the name of John Bardo,
was fuffered to po!l fbr Mr. Bamett. That John Job, a Cuftom
houfe Officer, J. Harrifon, a Soldiery and F. S. Bond two con-
vifted Felons, alfo polled. (Mr. Sergent Lens on a fubfequcnt day
gave the counfet f6r the fitting Member, a lid of eighty-five Vo-
ters for Mr. Bamett, to whom they meant to obje6l.)
That the Treating was mod enormous, particularly at the
Kinff*s Head, which mud, beyond all <|ueflion, make it a void
Ele^ion. That Mr. Bamett was preient there, and approved
and ailented to every thing that was going on.
The Mayor, and the Town Clefk^ were examined as to the
Bye Laws, and Cuflomall.
Saturday, Fcbroary 21, the counfcl for the Petitioners delivered
.in their ftalement of Right of £lc6tion fbr the City of Rocheiler,
to be in " All the Freemen not receiving alms.** (The

the Freemen admitted in right of being the eldeft Sons of Free-
men, Bom within the City^ by Servitude^ or Pun:hafe> and not

Mr. Henflow, and the Mayor were re-examtncd^ refpe6ting the
admidion of honorary Freemen. Mr. Henflow always confidered
that the roll of Parchment contained the Bye Laws under which
they a6ted, and not the Cuftomall. He underftood that a printed
copy of the Charter, and Bye Laws, was fent to each member
of the Corporation, on their ^dmiilion.
Mr. Dennis 0*Bryen was examined by Mr. Clifford, refpe6Hng
the proceedings on the huftings on the 3d of November, prior to
the meeting of the Corporation. His evidence chiefly went to
ilate his proted againft the Mayor's holding the corporate meet-
ing; that he was fupported in theproteftby teveral members of
the Corporation, but they were borne down by the clamour and
noife of the other party. On his crofs examination by Mr.
ttarrifon, he admitted that the Mayor exerted himfelf to facilitate
the ea(y kccefs of voters to the Poll table. He admitted he was
the author of a* letter in the papers refpe(5ling L5000, He denied
having faid with that money, he would keep the Poll open
fifteen days, but on the contrary. He admitted that on his firft
arrival, he produced the L5,CX>0, to the Mayor. He did not
adlually know that the Corporation bufinefs was going on, until
going to bed about Three o'Clock the next morning, he faw the
Hall illuminated.
He afterwards acknowledged he was on the ftairs of the Ha!!»
canvmlling the perfons waiting to be admitted. He did not join
with the Mayor and Mr. Calcraft in thanking the Freemen for
their orderly behaviour. He did hear the Mayor thank the
Freemen at. intervals, which be thought they did not deferve.
Refpe^^ing the general conduft of the Mayor.
On the firft day he did not conceal from the Mayor his cen-
iure and indignation at his improper conduct, on fubfequent days
he often bore teftimony of his uri6k impartiality, but on the whole
fail cenfure would outweigh his panegyric.
.He acknowledged that notwith (landing the violent outrages,
noife, and clamour, nothing did ultimately prevent^ the Freemen
from voting.
The Bribenr oath was not adminiftered until the fecond day*

but that it was not the money of Sir Sidney Smith ; it was given
by a perfoa who never faw Sir Sidney Smith, it was advanced
wholly out of refpe£t to Sir Sidney's character.
Monday, February 23.
Mr. Simmons and the Town Clerk produced former Poll
Books, and were examined refpeaing honorary Freemen.
** The Committee determined that the right of Voting for mem-
*' bers to (erve in Parliament at Rocheller is in all the Freemen not
'* receiving alms or charity."
Mr. Hen (low was examined refpe6ling the proceedings that
took place on the Hulling?, and at the corporate meeting, on the
3d of November; he fpoke from bis minutes made at the time:
he conceived the meeting to be illegal, and irregular, and pro-
tefted againfl it to the Mayor. In many inflances he faid the
neceffary documents were difpenfed with, and leveral perfbna
therefore improperly admitted. He adviled the Mayor at Twelve
o*Clock to adjourn, which he refufed; he again advifed him at
One o'clock, but without efl'ecl, and the bulinefs finally dofed
at about half paft two. He never recolle£led attending a meeting
before where they were detained longer than eight or nine o'Clock,
On crofs examination by Mr. Plumer, Mr. Henflow ftated he
frequently attended Sir Sidney Smith's friends at the Bull, but
that he was not one of the Committee. He received his notice
to attend the meeting on Thurfday, previous to the 3d of Novem-
ber. He had been twice Mayor, and during his fecond Mayor-
alty, not above two or three meetings wer^ held, he regularly
iliued notices, but could not get a quorum.
At the meeting of the 3d of November, the cales of the pcrfons
applying to be admitted, were difcuiied in the ufual way, he
did not recolleft the leatl partiallity in the Mayor. When a
perfon came in, he queftioned him on one fide, and Mr. Simmons
on the other fide: every body was at liberty to a(k queftions. He
did not recolledl a fingle inftance before this meeting, where
a pcribn was admitted without producing the ufual certificate.
Seventy |>erfons applied at this meeting, and forty-nine were
admitted.
Edmund "Baker, (crgeant at Mace, proved the notices to tl>e
members of the Corporation were ferved in the ufual way, and
tliat he received diredtion from the Mayor on tjie 20tb of Odlobcr.

manner ; be flated that in many indances prior to this meetings
perfons had been admitted without producing the ufual docu*

Mr. J. Snatt was 'examined. He attended the meeting of the
3d of November, and proteftcd again (I the proceedings ; was not
quite certain whether perfons had at any former meeting been
admitted without the neceflary certificates. He was a friend of
Sir Sidney Smith, and frequently attended their committee 5 he
gave them every ai&ftance he could refpe6ling the Voters, and
attended Mr. O'Bryen and the friends of Sir Sidney Smith oa
their canvafs, for the puq^ofe of pointing out the perfons and
reiidence of the Freemen. At the Corporation meeting, about
eight or nine perfons were admitted without producing their
regular certificates, ibme were friends of Mr. fiarnett, and fome
of Sir Sidney Smith.
He-examined by Mr. Dallas, he falJ he has before known
peHbns admitted without the regular certificate^ but not fre-
quently.
Mr. Alderman Ford was examined to prove he never had
known an inftance of Freemen being admitted during an Eledion.
He protefled againft the meeting. He acknowledged the Roll
of Parchment figned by the members of the Corporation, con-
flituted the Bye Laws by which they a6led.
Mr. S. Nicholfon was examined. The proceedings on the 34
of November were regular, and in the ufual way: he was prefent
the whole time; attended infide the door, for the purpole of
facilitating the businefs, and was oocafionally relieved by Mr. £.
Manclark, and Mr. Snatt, two of the junior members of tho
Corporation, and zealous friends of Sir Sidney Smith. The
claims ot every one were fairly and impartially coniidered, in
the order in which they came up. Has known frequent indancea
when the neceilary certificates have been difpenfed with. It was
not more done at this meeting, than at any former one. It waa
done indifcriminately to one party as to the other.
Mr. E. Manclark was examined. He attended the meeting
of the 3d of November, and protefted againft the proceedings,
he denied relieving Mr. Nicholfon as Dear kecfer.
February 24. Counftl were heard on both (ides on the vali<lily
af the Bye Law. The Committee came to a rcfolution,
" That it docs not appear to the Committee that there is any

validity in the fuppofisd Bye Law infixed upon by the ^titioners,
or any fuch img^Iarity in the proceedings of the meeting of the
Corporation, on the 3d of November, 1806, as to have vitiated
the admtlSon of Freemen having inchoate Rights.**
Mr. Sergent Lens proceeded to a Scrutiny of Votes. John
Jordan, (en. William Frazier, John Harrifon, Taylor, and John
Lammas, Voters for Mr. fiamett, weiie proved to have received
parifh relief, by tbemfelves' or families, and their votes allowed
Bid.
Charles Dunktn, and John Moore, voters for Sir Sidney Smithy
were allowed Bad, on the lame grounds.
The couiifel for the Petitioners then objected to the votes of
Jofeph Oliver, Robert Norman, Henry Webb, and John Corns,
on the grounds of being excufed Poor Rates. The Committee
did not come to a decifion re(pe£ling thofe votes, as the Petition-
ers counfel abandoned their objections to them.
ThuHHay, Feb. 25. Abraham Lloyd, examined, rdpeCling the
vote of Dorrell Clewes : was a(ked it he had received pariih relief
from November, 1805, to November, 1806, he replied in the
negatiyj.
The Town Clerk called in again, .and produced the record of
the Convi^ion of John Harrifon, a Soldier.
Thomas BiOiop examined, indentified the perfon of John
Harrifon, as being the fame perfon who voted at the laft £le6Uon.
£. Tanner, of the Cuftom houie, called in and examined. He
ptoved that John Job had been employed as a lide waiter within
the year.
William Knowles parifli Officer of Aylcsford, proved that
Robert Taylor had received pariih relief within the year.
The Town Clerk re-examined, and indentified Charles Dunkin,
Robert Taylor, and John Moore, as having polled at the Elec-
tion : the votes of J. Harrifon, Soldier, J. Job, and R. Taylor,
allowed to be Bad,
Counfel and Agents for the Petititioners withdrew, and upon
their return Mr. Sei^gent Lens addrefled the Committee and
itated, that being difappointed in Evidence, to eflablifh a clear
Majority for Sir Sidney Smith, they ihould chcn proceed to the

Freemen were entertained at his houie, on the evening of the 3d
of November, he gave general inftruftions to his lervants to
give refreihment only to out-voters. In the confuiion it was
Impoilible to fay but m-dwellen might have bejen treated. Does
iik>t know who Mr. Bamett*s Committee were. Mr. Bamett
was backwards and forwards in the houfe, but he does not know
that he ever dined there.. His bill amounted to upwards of
L7OO,. he ipcludi^ in t^e bill about 3 or L4OO for the wear and
tear of his furniture, &c. provifions for the Band and Colour
men; Itkewife Poft Chasie hire for out-dwellers. Had in his
liouie at the fame time, parties of other Freemen from different
places. His bill is not paid; delivered it no one in particular;
lent it to the Committee room: does not know by whom he
ihall be paid. Being afked if be had any dire6lion8 from par-
ticular perlbns, he replied that he a^ed more from his own
head than otherwiie. Was directed by Alderman Baker in the
firfl inftanoe, to fumifli entertainment for out-dwellers; looks
to him more than any other perfon for payment.
J.Baker, an out- voter, examined. Called to prove general
Treating at the King*s Head ; he faw Mr. Bamett in the houi^
two or three times, but did not hear him give any orders.
John Taylor, called alfo to prove Treating at the King*s
Head. He partook of a dinner, a g^reat many perfons were
prefent ; went there to accompany his two late apprentices who
were out-dwellers.
John Fielder a young Freeman examined. He faw no Treat-
ing at the King's Head, waited there tilt be was called to be
fwora ; was in the Houfe fix hours, and took one glais of wine
with a friend.
J. Watfon, vi6bialler, examined. He keeps the Dredging
Boat, Strood. His houfe was open during the £Ie6lion. Forty
or fifty Freemen were conllantly entertained there, at all hours
